01. APPLICABILITY
These Terms and Conditions of Sale apply to all offers, orders, and contracts for the sale of products or services through the Carvision Pro website (www.carvisionpro.com). By placing an order, you agree to be bound by these terms, complemented by our General Terms and Conditions of Use, Privacy Policy, and Refund Policy.
02. PRODUCTS AND SERVICES
Carvision Pro offers automotive services, memberships, apparel products, and brokering for vehicle purchase and sale through our marketplace. All products and services are subject to availability. We reserve the right to limit the quantities available for sale.
03. ORDERS AND ACCEPTANCE
Offer: The products/services displayed on our website constitute an invitation to make an offer. By placing an order, you send us a binding offer to enter into a purchase contract.
Order Confirmation: You will receive an automated email confirming receipt of your order. However, this does not constitute acceptance of your offer.
Acceptance: Acceptance of your offer occurs when we send you an order confirmation (including an order number) or when we begin performing the service (whichever occurs later). We reserve the right to reject an order for any reason.
04. PRICES AND PAYMENT
Prices: All prices are displayed in US Dollars (USD) and include applicable taxes as required by law (unless otherwise indicated). We reserve the right to change prices at any time, but changes will not affect orders we have already accepted.
Payment: Payment must be made using the payment methods offered during the checkout process (e.g., credit/debit card, online payment systems). You warrant that you are authorized to use the selected payment method.
Funds Capture: We only capture funds when your order is confirmed.
Refunds: The applicable Refund Policy is detailed in a separate document.
05. PROVIDER OBLIGATIONS (SPECIAL FOR COLOMBIA)
In accordance with Colombia's Law 1480 of 2011 (Consumer Statute) and Law 2439 of 2024, Carvision Pro commits to:
- Clear Information: Provide accurate, reliable, sufficient, clear, and up-to-date information about the products and/or services offered, including technical specifications, features, price, offer validity period, product availability, and minimum duration for successive contracts.
- Customer Service Channels: Maintain easily accessible channels on the same electronic medium to ensure guidance and assistance to consumers, guaranteeing traceability of claims with a registration number that includes date and time.
- Delivery: Deliver the order within the timeframe accepted by the consumer. If not stipulated, the maximum term will be thirty (30) calendar days from the order confirmation.
- Product Unavailability: Immediately inform if a product is unavailable, allowing the consumer to decide whether to continue with the transaction, and proceed with the refund if requested.
- Refund of Money: In case of refund (due to right of withdrawal, defective product, or unavailability), the refund will be made directly to the payment method used (or by agreement between the parties) within fifteen (15) calendar days following the exercise of the right by the consumer, provided the consumer has fulfilled their obligations (providing correct data, returning the product, etc.).
06. RIGHT OF WITHDRAWAL (SPECIAL FOR COLOMBIA)
Consumers in Colombia have the right to withdraw from a purchase within five (5) business days following receipt of the product (or the signing of the contract for services), without penalty and without needing to justify their decision, in accordance with Article 47 of Law 1480 of 2011.
Exceptions to the right of withdrawal include customized products, perishable goods, opened software and CDs/DVDs, and certain already rendered services. To exercise the right of withdrawal, the consumer must notify their decision to Carvision Pro through the designated customer service channels before the expiration of the aforementioned period.
07. GEOGRAPHIC AVAILABILITY AND SHIPPING
Digital Services (SaaS, Memberships, Online Academies): Available globally through our website.
Marketplace and Physical Services: Restricted based on location. For the purchase of vehicles through our marketplace, additional terms will apply and will be provided to you before the transaction. The applicable shipping cost will be communicated to you before you finalize your order.
08. WARRANTIES
Products sold through Carvision Pro may be covered by limited warranties, which will be provided according to the product. For consumers in Colombia, the minimum legal guarantees established in the Consumer Statute are respected.
09. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Carvision Pro shall not be liable for indirect or consequential damages, such as loss of profits, arising from the purchase or use of our products or services. For consumers in Colombia, this limitation does not affect the inalienable rights established in the Consumer Statute.
10. GOVERNING LAW
These Terms of Sale are governed by the laws of the State of Florida and the federal laws of the U.S. However, when you act as an end consumer in Colombia, you are guaranteed the rights granted by Law 1480 of 2011 and Law 2439 of 2024, which will prevail in case of conflict.
